These Public Website Terms of Use (“Terms”) govern access to and use of TeamCME.com and any related public-facing websites, webpages, content, tools, resources, chat features, and directories that link to these Terms (collectively, the “Site”).

For purposes of these Terms, “TeamCME,” “we,” “us,” and “our” mean JAM Medical, LLC, a Wyoming limited liability company, doing business as TeamCME, unless otherwise stated.

By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Scope of These Terms

These Terms apply to public use of the Site, including:

  • browsing directory listings;

  • reading articles, FAQs, and resource pages for drivers, providers, employers, and others;

  • using public-facing tools or chat features;

  • contacting TeamCME through forms, chat, phone prompts, or similar features; and

  • purchasing or accessing public-facing products or services, unless a separate agreement applies.

If you enroll in training, become a member, request lab-access services, enroll in consortium-related services, purchase store products, or use another TeamCME offering subject to a separate agreement, that separate agreement will control to the extent of any conflict.

2. Site Purpose and General Nature of the Site

The Site provides educational content, informational resources, directories, business information, and general tools related to DOT physicals, drug and alcohol testing, training, and related services.

The Site may include:

  • listings for independently owned businesses, clinics, examiners, collectors, or other providers;

  • articles and evergreen resource pages for drivers, employers, and providers;

  • access points for TeamCME memberships, training, store items, administrative services, or other offerings; and

  • chatbot or AI-assisted tools.

Content on the Site is for general informational and educational purposes only.

3. No Medical, Legal, Compliance, Employment, or Professional Advice

The Site does not provide medical advice, legal advice, compliance advice, employment advice, or other professional advice.

Nothing on the Site creates:

  • a physician-patient relationship;

  • a provider-patient relationship;

  • an attorney-client relationship;

  • an employer-agent relationship beyond any express written services agreement;

  • a fiduciary relationship; or

  • any duty of care by TeamCME to any user.

Users are solely responsible for evaluating whether any provider, service, test, course, product, or resource is appropriate for their needs.

4. Directory Listings and Marketplace Disclaimer

The Site may include a directory or marketplace-like listing experience that helps users identify providers or businesses offering DOT physicals, drug testing, alcohol testing, consortium-related services, or similar services.

All listed providers are independently owned and operated unless expressly stated otherwise.

TeamCME:

  • does not employ listed providers merely because they appear on the Site;

  • does not practice medicine;

  • does not supervise, control, or direct the clinical, testing, collection, or business operations of listed providers;

  • does not guarantee the accuracy, completeness, currentness, licensure status, availability, pricing, qualifications, insurance, wait times, quality, legality, or outcomes of any provider or service; and

  • does not vet, endorse, certify, or approve listed providers unless TeamCME expressly says so in writing as part of a separate, clearly described verification program.

Provider listings may be created, submitted, or updated by the provider, by TeamCME based on available business information, or by other sources. Listing information may change without notice.

Users must independently verify any provider information, including services offered, fees, insurance, appointment availability, location, licensure, qualifications, regulatory status, and suitability.

Any interaction, appointment, communication, payment, testing service, examination, treatment, or other transaction with a listed provider is solely between the user and that independent provider unless a separate written agreement expressly states otherwise.

5. Search Results, Proximity, and Visibility

Directory results may be displayed based on one or more factors, including user location, the location entered in a search, relevance, business information available to TeamCME, user experience considerations, and other factors we choose to use.

TeamCME may also offer paid memberships, enhanced listings, featured placement, or other promotional opportunities. Visibility, prominence, and presentation may be influenced by such factors where applicable.

A listing’s presence, order, badge, description, or prominence does not constitute an endorsement, guarantee, certification, or representation by TeamCME regarding quality, legality, availability, pricing, or outcomes.

6. Articles, Resources, and Educational Content

The Site may publish articles, FAQs, guides, evergreen resources, summaries, and other educational content for drivers, employers, members, and providers.

This content is provided as a general informational resource only. Laws, regulations, agency guidance, industry practices, and business information may change. TeamCME does not guarantee that any content is complete, current, error-free, or applicable to any specific person, company, test, exam, or factual situation.

You are responsible for independently reviewing current official sources and applying your own professional, business, legal, and clinical judgment as applicable.

7. Chatbots, AI Tools, and Other Automated Features

The Site may offer chatbots, AI-assisted tools, search tools, or other automated features.

Outputs from these tools are generated automatically and may be incomplete, inaccurate, outdated, or inappropriate for a particular situation. They are provided for general informational purposes only and are not a substitute for independent review of current official sources or for professional judgment.

Do not rely on any chatbot or AI output as the sole basis for a medical, clinical, legal, compliance, employment, certification, testing, or business decision.

Unless expressly allowed in a separate written agreement, do not submit highly sensitive information, full Social Security numbers, or unnecessary patient-identifying information through public chat or bot features.

TeamCME may monitor, review, log, suspend, limit, or discontinue automated tools at any time.

8. No Emergency Use

The Site is not intended for emergencies or urgent medical, testing, legal, or safety situations. If you have an emergency, contact appropriate emergency services or qualified professionals directly.

9. User Responsibilities

You agree to use the Site lawfully and responsibly.

You must not:

  • use the Site for unlawful, fraudulent, misleading, or harmful purposes;

  • submit false or misleading information;

  • interfere with or disrupt the Site or related systems;

  • attempt to gain unauthorized access to the Site or accounts;

  • scrape, harvest, copy, or reuse Site data or listing data for resale, lead generation, spam, or competing commercial purposes;

  • upload or transmit malware or malicious code;

  • use the Site to harass, threaten, defame, or impersonate others; or

  • use public chat or form tools to submit information you are not authorized to share.

10. Accounts and Separate Services

Certain portions of the Site may connect you to separate TeamCME offerings such as memberships, training, store purchases, lab-access services, or consortium-related services.

Those offerings may require additional agreements, consents, authorizations, or payment terms. TeamCME may deny, suspend, limit, or terminate access to any account, tool, or service at any time for nonpayment, misuse, security concerns, legal risk, suspected fraud, inaccurate information, or violation of these Terms or any separate agreement.

11. Third-Party Providers, Tools, and Links

The Site may contain links to third-party websites, scheduling platforms, maps, payment processors, labs, software providers, articles, or other services not controlled by TeamCME.

TeamCME is not responsible for the availability, content, practices, terms, privacy policies, actions, omissions, products, services, or results of any third party.

Your use of third-party services is at your own risk and subject to the third party’s own terms and policies.

12. Intellectual Property

The Site, including its text, design, logos, graphics, software, compilations, resource materials, and other content, is owned by TeamCME or its licensors and is protected by applicable intellectual property laws.

Subject to these Terms, TeamCME grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for its intended personal or internal business purposes.

You may not reproduce, republish, distribute, modify, create derivative works from, frame, mirror, sell, license, or exploit Site content except as expressly permitted in writing by TeamCME.

13. Feedback and User Submissions

If you submit comments, ideas, suggestions, feedback, reviews, messages, uploaded materials, or other content to TeamCME through the Site, you grant TeamCME a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and otherwise exploit such content in connection with operating, improving, promoting, and protecting the Site and related services, subject to applicable law and our Privacy Policy.

You represent that you have the right to submit such content and that it does not violate any law or third-party right.

We may, but are not obligated to, monitor, review, edit, remove, or refuse content in our discretion.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, LISTINGS, ARTICLES, RESOURCES, TOOLS, BOTS, FEATURES, AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TEAMCME DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR THAT THE SITE WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, CURRENT, OR FREE OF HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, TEAMCME MAKES NO WARRANTY REGARDING:

  • any listed provider or third party;

  • the accuracy or availability of directory information;

  • the completeness or currentness of articles or resources;

  • the output of any chatbot or AI tool; or

  • the suitability of any provider, service, product, course, or test.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEAMCME AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEAMCME WILL NOT BE LIABLE FOR ANY CLAIMS, DAMAGES, LOSSES, OR INJURIES ARISING OUT OF OR RELATED TO:

  • services performed by listed providers or other third parties;

  • user reliance on Site content, articles, listings, resources, or chatbot outputs;

  • regulatory, clinical, testing, employment, or business decisions made by users or third parties;

  • outages, delays, or failures of third-party services; or

  • unauthorized access, data incidents, or security events except to the extent liability cannot be limited under applicable law.

IF, NOTWITHSTANDING THE FOREGOING, TEAMCME IS FOUND LIABLE FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE, TEAMCME’S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO TEAMCME FOR THE SPECIFIC PUBLIC-FACING SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain disclaimers or limitations, so some portions of this Section may not apply to you to the extent prohibited by law.

17. Indemnification

You agree to defend, indemnify, and hold harmless TeamCME and its owners, affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use of the Site;

  • your violation of these Terms;

  • your violation of any law or third-party right;

  • information or content you submit; or

  • your misuse of listings, resources, bots, or other Site features.

18. Force Majeure

TeamCME will not be liable for any delay, interruption, or failure to perform resulting from events beyond its reasonable control, including acts of God, natural disasters, epidemics, pandemics, labor disputes, war, terrorism, civil disturbances, utility failures, internet or communications failures, cyberattacks, governmental actions, vendor outages, or supply disruptions.

19. Termination and Suspension

TeamCME may suspend, restrict, remove, or terminate access to the Site or any portion of it at any time, with or without notice, for any lawful reason, including violation of these Terms, suspected fraud, abuse, legal risk, security concerns, or protection of TeamCME, users, providers, or third parties.

20. Changes to the Site or These Terms

TeamCME may modify the Site, any Site feature, or these Terms at any time. The updated version will be posted with a revised “Last updated” date. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

Before filing any formal legal claim, you and TeamCME agree to try to resolve the dispute informally by providing written notice of the dispute and allowing the receiving party at least thirty (30) days to respond.

Except for disputes that qualify for small claims court, and except for claims by TeamCME for injunctive or equitable relief relating to intellectual property, unauthorized access, scraping, misuse of the Site, fraud, or collection of amounts owed, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by final and binding arbitration on an individual basis.

The arbitration shall be administered by the American Arbitration Association (AAA) under its applicable consumer or commercial arbitration rules, as appropriate. The arbitration may be conducted remotely, in a mutually agreed location, or in the county where TeamCME’s principal office is located, unless applicable law requires otherwise. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

YOU AND TEAMCME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION OR PROCEEDING.

To the fullest extent permitted by law, you and TeamCME waive any right to a jury trial for any dispute not subject to arbitration.

If a court or arbitrator determines that the class action waiver in this Section is unenforceable as to a particular claim or request for relief, then that claim or request for relief shall be severed and litigated in a court of competent jurisdiction, and the remaining portions of this Section shall remain in full force and effect.

22. Severability and No Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. A failure by TeamCME to enforce any provision is not a waiver.

This Privacy Policy explains how JAM Medical, LLC, a Wyoming limited liability company, doing business as TeamCME (“TeamCME,” “we,” “us,” or “our”), collects, uses, discloses, and protects information through TeamCME.com and any related websites, pages, directories, forms, chat tools, training pages, membership pages, or services that link to this Privacy Policy (collectively, the “Site”).

1. Scope

This Privacy Policy applies to information we collect online through the Site and related digital interactions. Different or additional privacy terms may apply to certain services, transactions, or relationships where we provide a separate notice, services agreement, or business associate agreement.

2. Categories of Individuals Whose Information We Collect

Depending on how you interact with TeamCME, we may collect information about:

  • website visitors;

  • drivers and other individuals searching for providers or resources;

  • listed providers and prospective providers;

  • members and prospective members;

  • students and prospective students;

  • employers and owner-operators;

  • individuals or companies requesting lab-access or consortium-related services;

  • customer support contacts; and

  • users of chatbots, AI tools, forms, or other interactive features.

3. Categories of Information We Collect

Depending on the context, we may collect the following categories of information:

A. Contact and account information

Examples include name, company name, job title, email address, mailing address, billing address, phone number, account username, and similar identifiers.

B. Business and professional information

Examples include clinic name, business type, provider type, business location, services offered, certifications claimed, licensing-related information submitted by you, DOT-related service capabilities, and directory/listing information.

C. Transaction and payment information

Examples include purchase details, subscription details, billing records, invoice records, payment status, payment method type, and limited payment confirmation data provided by our processors.

We do not store full payment-card numbers on our own servers when payments are processed by our third-party payment processors.

D. Site usage and device information

Examples include IP address, browser type, device type, operating system, referring URLs, pages viewed, dates and times of access, clickstream data, approximate location derived from IP, and analytics data.

E. Search, inquiry, and submission information

Examples include directory search inputs, messages sent through forms, support requests, bot/chat questions, survey responses, comments, uploads, and other content you submit.

F. Geolocation information

If you allow browser-based location access, we may collect approximate or precise location information as provided by your browser or device in order to show relevant nearby results or improve the user experience.

G. Sensitive or regulated information

In limited cases and depending on the service, we may collect information such as the last four digits of certain identifiers, driver- or employer-related program information, or other information you choose to provide in forms, support requests, or service workflows.

Please do not submit full Social Security numbers, unnecessary medical information, or other highly sensitive information through public forms or public chat features unless expressly requested through a secure and appropriate workflow.

4. Sources of Information

We may collect information:

  • directly from you;

  • from your browser or device;

  • from cookies and analytics technologies;

  • from business partners, vendors, or service providers;

  • from directory submissions, membership applications, service-request forms, and training registrations;

  • from public business information; and

  • from communications with our team.

5. How We Use Information

We may use information for the following purposes:

  • to operate, maintain, secure, and improve the Site;

  • to process transactions and provide requested products or services;

  • to create, maintain, and manage accounts;

  • to publish and manage directory listings;

  • to provide memberships, training, support, administrative services, and related offerings;

A. Service providers and vendors

We may disclose information to hosting providers, website platforms, analytics providers, chatbot or AI vendors, learning-management vendors, payment processors, email and communication providers, customer-support providers, fraud-prevention providers, software vendors, and other service providers that help us operate the Site or our business.

B. Providers, members, employers, or other business counterparties

Where appropriate to the service you requested, we may share information with listed providers, members, employers, owner-operators, labs, MROs, consortium-related vendors, software platforms, or other business counterparties involved in the requested service or workflow.

C. Affiliates under common ownership or control

We may disclose information to affiliated companies under common ownership or control with TeamCME, including for internal business, operational, administrative, customer-support, service-development, marketing, or related business purposes, subject to applicable law.

D. Professional advisors and business transfers

We may disclose information to lawyers, accountants, insurers, auditors, lenders, investors, and parties involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction.

E. Legal and safety disclosures

We may disclose information when reasonably necessary to comply with law, legal process, governmental requests, enforce our rights, investigate misconduct, protect safety, or respond to fraud or security issues.

F. With your direction or consent

We may disclose information at your direction or with your consent.

7. Cookies, Analytics, and Similar Technologies

No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

The Site may link to or integrate with third-party sites, tools, booking systems, platforms, labs, payment providers, maps, or services. We are not responsible for the privacy or security practices of those third parties, and their own terms and policies apply.

12. Children’s Privacy

The Site is intended for adults and business users and is not directed to children. We do not knowingly collect personal information from children under 13 through the Site. If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take reasonable steps to delete it.

13. Your Choices

You may choose not to provide certain information, but doing so may limit your ability to use features or receive services.

You may unsubscribe from promotional emails using the unsubscribe link in the message. Even if you opt out of promotional messages, we may still send you transactional or administrative communications.

You may also control certain cookies and browser-based location permissions through your device or browser settings.

Depending on your U.S. state of residence and subject to applicable law, you may have certain rights regarding your personal information, such as the right to:

  • know or access certain information about the personal information we collect, use, disclose, sell, or share;

  • request deletion of certain personal information;

  • request correction of certain personal information;

  • opt out of certain sales, sharing, targeted advertising, or profiling activities;

  • limit certain uses or disclosures of sensitive personal information where applicable; and

  • not be discriminated against for exercising applicable privacy rights.

15. California Privacy Notice

If you are a California resident, California law may provide additional rights, including the right to know, delete, correct, opt out of sale or sharing, and receive equal service and pricing for exercising privacy rights, subject to exceptions and limitations.

TeamCME does not sell personal information for money. TeamCME may use email addresses and related contact information for its own email marketing and communications as described in this Privacy Policy. If TeamCME later engages in activities that require an opt-out method under California law, TeamCME will provide the required opt-out mechanism, including recognizing Global Privacy Control signals where required by law.

California residents may exercise applicable rights by emailing contact@teamcme.com.

16. International Users

The Site is intended primarily for users in the United States. If you access the Site from outside the United States, you understand that your information may be transferred to and processed in the United States and other jurisdictions where our vendors operate, which may have different data-protection laws.
